If the vendor cannot or does not perform, there need to be set criteria and time deadlines to recognize that fact and terminate the contract.

The system should have specified performance levels.  This can include screen response times under heavy load and users. 

Any custom work that is necessary should be specified clearly along with a statement of the cost and payment schedule.
