Abstract:
Legislations and legal systems have posed countless struggles to indigenous people, such as failures to effectively recognise and protect their identity, culture and language(s), and difficulties to enforce and uphold the existing laws. It is in relation to indigenous peoples’ land rights that the failures of legal systems are the most evident, although the reasons are greatly dependent on contextual factors such as the individual community, the nature of the rights sought and the pressure of the State for the available natural resources.
